Privacy Policy
Last updated October 31, 2026
This policy aims to inform you, clearly and accessibly, about the personal data we collect in connection with MySongly, the purposes pursued, any recipients, retention periods, and the rights available to you. It applies to the website and all associated services.
Section I: Data controller
The controller of personal data collected through MySongly is AUXO MARKETING, whose registered office is located at 58 rue de Monceau, 75008 Paris, France.
For any question about your data or the exercise of your rights, you can write to us at hello@mysongly.com.
Section II: Data collected
Depending on how you use the service, we may collect the following categories of data:
- identification and contact data (email address, and possibly a first or last name);
- the content of your order (questionnaire answers, first names, memories, musical preferences, photographs for a cover, etc.);
- transaction data (amount, currency, payment status — via our provider Stripe);
- technical browsing data (IP address, device type, pages viewed, cookies and trackers);
- exchanges with our support team, as well as any feedback on the service.
The memories and personal information you share in the questionnaire are processed primarily to design, produce and deliver your song, then to follow up on your order and handle any related revisions.
Section III: Purposes and legal bases
We process your data on the following bases, as applicable:
- performance of the contract: creating, producing, delivering, revising and following up on your order;
- legal obligations: accounting, invoicing, responding to competent authorities;
- legitimate interest: securing the service, preventing fraud, improving the experience, compiling aggregated statistics, defending our rights in case of dispute;
- consent: non-essential cookies, audience measurement or marketing communications where required by law — consent you may withdraw at any time.
Section IV: Recipients
Your data is accessible to authorized personnel within the company, strictly to the extent they need it. It may also be shared with technical service providers, only to the extent necessary for the service to operate:
- secure payment: Stripe;
- hosting and infrastructure: Vercel and associated cloud services;
- sending transactional and, where applicable, marketing emails (for example Resend, Brevo);
- music, visual or creative production tools — including Artificial Intelligence technologies — used to bring your order to life.
We do not sell your personal data to third parties.
Section V: Retention periods
We keep your data only for as long as necessary for the purposes pursued, subject to legal obligations:
- order and billing data: the period required by accounting regulations (up to ten years in practice);
- creative files and content: for as long as useful for the service, re-listening, re-downloading and support, then deletion or limited archiving;
- marketing data, where applicable: up to three years after the last contact, or until you object or withdraw consent;
- technical logs: a short period, linked to security and diagnostics.
Section VI: Transfers outside the European Union
Some of our service providers may be established outside the European Union, notably in the United States. In such cases, we ensure that appropriate safeguards are in place — standard contractual clauses, adequacy decisions, or equivalent mechanisms recognized by applicable regulations.
Section VII: Cookies and trackers
The website may place cookies strictly necessary for its operation (session, language or currency preferences) and, where applicable, trackers used for audience measurement or advertising purposes.
You can configure your browser to refuse all or some cookies. Refusing non-essential cookies does not prevent you from placing an order; it may, however, limit certain measurement or personalization features.
Section VIII: Your rights
Under the General Data Protection Regulation (GDPR) and the French Data Protection Act (loi Informatique et Libertés), you have, in particular, the rights of access, rectification, erasure, restriction, objection and, where the conditions are met, data portability. You may also object to direct marketing.
To exercise these rights, write to us at hello@mysongly.com. We may ask you for information to verify your identity. You also have the right to lodge a complaint with the French data protection authority, the Commission nationale de l’informatique et des libertés (CNIL — www.cnil.fr).
Section IX: Security
We implement reasonable technical and organizational measures designed to protect your data against unauthorized access, loss or alteration. As no system is completely impenetrable, we encourage you not to send highly sensitive information through unsecured channels.
Section X: Changes
We may update this policy to reflect changes in our practices, the service or regulations. The date of the last update appears at the top of the page. In the event of a material change, we may notify you by email or via a notice on the website.
