Terms of Service

MySongly is a service designed and operated by AUXO MARKETING. It lets you order an original song created from the details you share in the questionnaire: recipient, occasion, memories, first names, desired tone, musical style and any other information useful for personalization.

MySongly productions rely on a range of contemporary music-creation tools, methods and expertise. In this context, the company uses Artificial Intelligence, among other technologies and production processes, to bring carefully personalized tracks to life.

By confirming an order, you confirm that you have read these terms and the Privacy Policy and accept them without reservation. These documents may change; the version applicable to your purchase is the one published at the time of payment.

You declare that you have the legal capacity to enter into a contract and use the service. When you provide information about a minor or a third party — first name, anecdotes, a photograph for a cover, etc. — you warrant that you hold all necessary rights, authorizations and consents.

You are solely responsible for the accuracy and completeness of the information you provide: email address, spelling of names, story details, artistic preferences. An error, omission or inaccuracy on your part does not, in itself, give rise to a right to a refund or to unlimited free rework.

By placing an order, you make an offer to purchase. AUXO MARKETING reserves the right to accept, refuse, suspend or cancel an order, in particular where the content is illegal, abusive, fraudulent, technically unfeasible or contrary to the spirit of the service.

An order is only final once payment has been confirmed. A confirmation message is sent to the email address provided; please check your spam folder. Any options (express delivery, lyrics / karaoke and other add-ons) are selected at checkout.

Please review your questionnaire carefully before paying: once creation has started, some changes may no longer be possible without a revision or additional fees.

Prices are shown inclusive of all taxes, in the currency displayed at the time of purchase. They may change at any time; the price charged to you is the one in force when payment is actually made. Occasional promotions may apply under their own terms.

Payment is secured through our payment provider (Stripe). AUXO MARKETING does not store your full card numbers. By making a payment, you warrant that you are duly authorized to use the chosen payment method.

The service is delivered exclusively in digital form: a private listening link and/or a downloadable file (including MP3), sent by email. No physical shipment is included unless clearly stated otherwise at the time of ordering.

• Standard turnaround: generally within seven (7) days of payment confirmation.
• Express option: faster turnaround shown at checkout, subject to operational availability.

Delivery is deemed completed as soon as the access link or file is made available to you — or as soon as the delivery email is sent — whether or not you actually open, view or download it. Stated timeframes are indicative. A mere delay does not automatically entitle you to cancellation or a refund.

We do not guarantee perpetual hosting, archiving or availability of links. We strongly recommend that you download and keep your files as soon as you receive them.

Every MySongly song is made to measure, based on your instructions and your story. It is not a standard product held in stock: each creation is unique, closely tied to your order, and cannot be resold as is to another customer.

Once creative work has begun, a cancellation for a simple change of mind is not an automatic right. However, if you are not satisfied with the delivered musical result, a refund guarantee applies under the conditions below.

• Paid options (express, add-ons and other upgrades) are, in principle, non-refundable once purchased.
• If an error solely attributable to us prevents delivery substantially conforming to the order, we may, at our option, re-deliver or issue a refund.
• Where applicable, payment-provider or production costs may be deducted from a refund, to the extent permitted by law.

If you believe a charge is incorrect, please contact us first at hello@mysongly.com so that we can look into it. Opening a chargeback without contacting us first may delay resolution; we reserve the right to dispute it and, in case of abuse, to suspend access to the service.

MySongly orders no longer include free revisions. Unless a contrary offer is clearly stated at the time of purchase, the delivered version is the final version of your song.

Paid revisions may occasionally be offered, subject to availability and a fee communicated to you in advance. A substantial request (radical change of style, complete rewrite, new artistic direction) may be declined or postponed.

We take particular care to produce a thoughtful, polished personalized song. As with any artistic creation, however, the result — melody, arrangement, vocals, lyrics, the emotion it evokes — may differ from what you had imagined. Examples shown on the website are illustrative; they do not promise an identical result.

We reserve the right to refuse, adapt, rephrase or discontinue an order whose content is illegal, hateful, defamatory, pornographic, or contrary to the ethics and customary use of the service.

Upon delivery, you receive a personal, non-exclusive and non-transferable license to listen to, download, gift and share the song in a private or family setting — including at a personal event such as a birthday, wedding or intimate ceremony.

Unless otherwise agreed in writing, you do not acquire commercial exploitation rights: advertising, resale, large-scale distribution, audiovisual synchronization for commercial purposes, etc. AUXO MARKETING retains the rights needed for production and the continuous improvement of the service and may, with respect for privacy, use anonymized feedback or excerpts for communication purposes.

By sending us content (texts, memories, photographs), you grant us a non-exclusive license to use it to produce, deliver, revise and improve your order.

Without limitation, you may not use the service to:

• distribute or have produced content that is illegal, defamatory, harassing, or infringes the rights of third parties;
• resell the service or delivered files without written authorization;
• circumvent security measures, scrape data at scale, or disrupt the operation of the website;
• impersonate anyone or knowingly provide false information.

The service is provided with due care, within the limits of reasonably available means. To the extent permitted by applicable law:

• we shall not be liable for indirect damages (loss of profit, reputational harm, loss of data, etc.);
• we shall not be liable for delays or unavailability attributable to third parties (email, host, network, payment provider) or to an error on your part;
• our total liability for any given order is capped at the amount actually received for that order.

Nothing in these terms limits the mandatory rights you hold as a consumer under French law, where those rights apply.

You agree to hold harmless and indemnify AUXO MARKETING against any third-party claim arising from (i) the content you provided, (ii) your breach of these terms, or (iii) any unlawful use of the service.

How we collect and process your personal data is described in our Privacy Policy, which we encourage you to read carefully.

These terms are governed by French law. If any issue arises, we invite you first to contact us so that we can seek an amicable solution.

In accordance with the rules on consumer mediation, after a prior written complaint that has not received a satisfactory response, you may refer the matter to a mediator. Prior contact: hello@mysongly.com.

Failing agreement, the matter will be brought before the competent French courts, subject to mandatory consumer-protection rules.

We may update these terms to reflect changes in the service, regulations or our practices. The version applicable to your order is the one published on the website on the date of payment. The date of the last update appears at the top of the page.
